Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website operated by The Law Offices of Kerri Jamison Brutto, PLLC (“Kerri Jamison Brutto Law Offices,” “we,” “us,” or “our”), including any contact forms, scheduling tools, and links to client services such as Clio for appointments, document sharing, and invoices.

By accessing or using our website or related online tools, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site.

1. Informational Purpose Only: No Legal Advice

Content on this website is for general informational purposes only and does not constitute legal advice. Laws change and facts matter; information on the site may not apply to your situation. You should not act or refrain from acting based solely on website content.

2. No Attorney-Client Relationship From Website Use

Using this website, submitting a contact form, booking an appointment, or sending an email does not create an attorney-client relationship. An attorney-client relationship is formed only when we expressly agree to represent you, typically through a signed engagement agreement and any required conflict clearance.

Until we accept representation, please do not send confidential or sensitive information you would not want disclosed. We may decline or withdraw from representation where ethically required or otherwise appropriate.

3. Eligibility and Acceptable Use

You agree to use the website only for lawful purposes and in a manner consistent with these Terms. You must not:

  • Attempt to gain unauthorized access to our systems, client portals, or other users’ data.
  • Upload malware, scrape the site aggressively, or interfere with site operation.
  • Misrepresent your identity or affiliation when contacting us.
  • Use the site to harass, threaten, or send spam.
  • Copy, republish, or commercially exploit site content without our prior written permission, except for personal, non-commercial reference use permitted by law.

4. Appointments, Clio Portal, Documents, and Invoices

We may offer online appointment scheduling, document sharing, invoicing, and payment through Clio or similar providers. Use of those features may require accepting Clio’s terms and creating or using account credentials.

You are responsible for maintaining the confidentiality of any portal login credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.

Documents shared through Clio are provided for your matter and should be handled securely. Invoices and payment pages may be processed by Clio and/or payment processors; their terms apply to payment transactions.

Missed appointments, cancellation policies, and fee arrangements (if any) will be communicated separately or in your engagement agreement.

5. Contact Forms and Communications

You agree that information you submit through forms or email is accurate to the best of your knowledge. We may respond by phone, email, or other reasonable means. Electronic communications may not be fully secure; do not use them for emergency situations. If you have an urgent legal matter, contact us by phone or seek emergency assistance as appropriate.

6. Intellectual Property

The website’s text, design, graphics, logos, and compilation are owned by The Law Offices of Kerri Jamison Brutto, PLLC or its licensors and are protected by intellectual property laws. Kerri Jamison Brutto Law Offices names and marks may not be used without permission, except as needed to identify us in good faith.

7. Third-Party Links and Tools

The site may link to third-party websites or embed third-party tools (including maps, analytics, Clio, or payment services). We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

8. Cookies and Tracking

We use cookies and similar technologies as described in our Privacy Policy. By using the site, you acknowledge that tracking technologies may be used as disclosed there, subject to any consent mechanisms we provide.

9. Disclaimers

THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, The Law Offices of Kerri Jamison Brutto, PLLC AND ITS ATTORNEYS, STAFF, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE WEBSITE OR RELIANCE ON ITS CONTENT. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE WEBSITE (EXCLUDING CLAIMS ARISING FROM AN ENGAGED LEGAL MATTER, WHICH ARE GOVERNED BY YOUR ENGAGEMENT AGREEMENT AND APPLICABLE LAW) SHALL NOT EXCEED ONE HUNDRED DOLLARS (US $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law. Nothing in these Terms limits liability that cannot be limited under Arizona law or professional responsibility rules.

11. Indemnification

You agree to indemnify and hold harmless The Law Offices of Kerri Jamison Brutto, PLLC and its attorneys and staff from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the website, violation of these Terms, or infringement of any rights of another, except to the extent caused by our gross negligence or willful misconduct, or as prohibited by law.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Subject to any mandatory arbitration or ethics requirements applicable to legal services, you agree that state or federal courts located in Arizona are an appropriate venue for disputes arising from website use.

13. Changes

We may revise these Terms at any time by posting an updated version with a new effective date. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.

14. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy and any engagement agreement you enter with us, constitute the agreement regarding website use. In a conflict between these Terms and a signed engagement agreement concerning legal services, the engagement agreement controls for that matter.
